An environmental group working to shut down Diablo Canyon Nuclear Power Plant in San Luis Obispo County is taking its argument to the U.S. Court of Appeals in Washington D.C.

Diablo Canyon is the only nuclear power plant still operating in California.

The man suspected of killing his parents and two sons last month in Santa Barbara County is scheduled to be in court for his arraignment this morning. 45-year-old Nicolas Holzer did not enter a plea during his last court appearance back on August 13.

Holzer faces four murder counts and one count of felony animal cruelty for killing the family dog.

A lawsuit aimed at keeping a Walmart from being built in Atascadero was shot down Tuesday by California's Second District Court of Appeals in Ventura.

The Atascadero City Council had approved the project two years ago. However, members of a citizens group called Save Atascadero were concerned over the project's Environmental Impact Report.

Tom Comar, the group's spokesperson, says the group will not seek any further legal matters on the issue at this time.

A sexually violent predator living as a transient in Santa Barbara County will have his round-the-clock supervision extended for another year.

The Santa Barbara District Attorney's office announced Wednesday that 61-year-old Tibor Karsai will continue to receive monitoring through GPS, plus two guards provided through Liberty Healthcare.

Karsai has twice been convicted of rape, including one that took place in Santa Barbara in 1974. He was released to the county a year ago on a court ruling. He's been under 24-hour supervision since his release and lives in a motorhome.
